Did you know that when selling online in Europe the taxes (VAT) are included in the purchase price? Did you know if you don’t increase your list price your margins shrink by the VAT amount? Did you know that if you have a UK company there is a minimum total revenue threshold amount you can reach before you have to collect VAT? Did you know the biggest mistake made by US companies is not registering for VAT, but that you can sell on Amazon prior to having the registration number? If you answered “no” to at least one of the above questions…and plan to expand to Europe, hearing Alex’s explanation of the VAT process could be critical to your expansion success. Episode Highlights: - The biggest mistake Alex sees is not registering for VAT, and it is costly! - You can sell before being registered, but it’ll cost you if you don’t increase your prices to account for VAT. - You do not have to set up a foreign corporation to sell in Europe, regardless of your overseas location: i.e. US, Singapore, etc. - You only collect in countries you are shipping from (there is a caveat). - Amazon does not show VAT charges separately in your seller account. - The PanEU program makes sense for some, most only register in the UK and Germany. - If you don’t pay VAT…your Amazon account will be suspended and/or closed (eventually). - “Import VAT” is charged on the inventory shipped into the country and paid immediately. - “Sales VAT” is charged on the retail price of your goods, and paid quarterly. - The UK and Germany are the two largest markets for selling online in the EU. - The UK is the easiest to expand to from the US because of language and the challenges of shipping to Germany. - Wiring VAT payments can take 4-5 days and a currency account in Europe shortens the wire times. - Using an intermediary bank, or currency account, can save 1-3% in exchange rate fees. - With Avask, the costs to register for VAT in the UK is about $200 USD, and then about $1200 USD per year. - Caveat to costs: “Distance Selling Thresholds”, if met, require more than $1200 per year because VAT is required in countries you do not store inventory in.

If there was no rule to prevent it, this could lead to the avoidance of VAT by a final consumer who was also a trader or employed by a trader: the business could purchase goods and recover the VAT on the cost, then give them to the owner or to an employee without consideration. The Directive provides that this transaction is subject to an output tax charge which negates the possible VAT avoidance. Oruga Group Business and Investment Law ► https://orugagroup.com/en Hi everyone In today’s video I am going to talk about reporting and refunds of Value Added Tax. the default tax period for VAT in Poland is one calendar month. However, the VAT reporting period, quarterly or monthly, can be selected by a business owner or management board when registering to #VAT . Polish monthly or quarterly VAT returns are due on the 25th of the month following the reporting period end. Any Polish VAT due must be paid at the same time. In the case where a #business has opted to file quarterly returns but is required to make monthly prepayments. If there is more VAT incurred than charged then a Polish VAT credit arises this is due back to the VAT registered business from the tax authorities. This credit can be refunded or carried forward to offset any tax due in the next period. A business applying for a VAT refund in #poland will be subject to time limits depending on the nature of the transactions involved. The current rules set a time limit of 60 days for the Polish authorities to pay back a VAT refund. This limit will be reduced to 25 days when a number of conditions are met. Where the conditions are not met, the 60 days limit will remain applicable. Also if there were no sales during the reporting period time limit can be prolonged to 180 days. The Polish VAT law also allows direct refunds when input VAT (available for deduction) exceeds output VAT. A Polish business may also be entitled to the VAT refund owed by another country under certain circumstances. Likewise, a foreign business having seat or fixed place of business for VAT purposes outside of Poland may be, in most cases, entitled to the refund of Polish VAT. If the respective countries belong to the European Union, the procedure is substantially simplified due to the EU Directive, which provides favourable rules for businesses based in EU countries that are seeking VAT refunds in other EU countries - so called electronic VAT refunds are possible. In this video I show how VAT applies to all Amazon FBA fees including FBA Fulfilment/Referral Fees and your Pay Per Click (PPC) Sponsored Ads. I also show how to calculate VAT. The easiest way to understand VAT is that there are two types - Input VAT (Purchases) and Output VAT (Sales). Input Vat - This is paid on all purchase product and services to VAT registered businesses. It is also paid and on imports from outside of the EU (i.e. China). Input VAT is reclaimable if you are VAT registered, otherwise it is not reclaimable. Output Vat - This is charged on all of your Amazon product sales once you become VAT registered, it does not apply if you are not registered for VAT. How to Calculate VAT: • Calculate 20% VAT by multiplying by 0.2 (or multiply by 1.2 for VAT inc. Total): £10 x 0.2 = £2.00 VAT£10 x 1.2 = £12.00 inc. VAT • Reverse calculate 20% VAT by dividing by 6 (minus from total for VAT exc. Total): £12 / 6 = £2.00 VAT£12.00 - £2.00 = £10.00 exc. VAT General Vat Notes: • Reclaiming VAT - You don't really claim VAT back (unless you have previously overpaid VAT to the HMRC), instead your Input VAT is deducted from your Ouput VAT and you pay the difference to HMRC. • The standard UK VAT rate is 20%, these are certain products that carry a lower rate e.g. Baby Clothes are 5% and Cycle Helmets 0%. • If your supplier is offering DDP (Delivery Duty Paid) shipping method you will need to ask them to provide an invoice in order to reclaim VAT. • If you use a freight forwarder they be able to supply the relevant VAT invoice. Non-VAT Registered vs VAT Registered Profit Margin Comparison • Non-VAT Registered Profit (Your Price £20.00 - Total Unit Cost £14.04) = £5.96 Per Unit • VAT Registered Profit (Your Price £16.67 - Total Unit Cost £14.04 + Total Input VAT £2.34) = £4.97 Per Unit • So despite charging £3.33 less for the product when VAT registered, in this example you only lose £0.99 of profit as you are able to reclaim £2.34 for Input VAT. The Polish Value-Added Tax Act of 11 March 2004 is based on European Union Legislation, and in particular, on the provisions of Directive 2006/112/EC on the common system of value added tax so-called the VAT Directive. VAT rates are as follows: 23% is a standard VAT rate. 8% is a reduced VAT rate - applied to supplies of certain food items, medical products, hospitality services and community housing. 5% is also reduced VAT rate - applied to supplies of certain food items, such as bread, dairy products, meats, and selected publications. Entities that wish to conduct activities subject to VAT in Poland must file a registration form before the date of the first taxable activity. Taxpayers who intend to conduct transactions between different EU countries must be EU VAT registered. The annual sales that do not exceed PLN 150,000 are exempt from VAT. However, the taxpayers may choose to pay VAT #tax. It depends on the scope of entity activities and in many cases it is more convenient for the entity to choose being VAT registered. Foreign companies can become a VAT registered companies too, but in order to register for VAT purposes in Poland, entities without a registered office in Poland, permanent place of residence or place of business in the European Union must appoint a tax representative. Tax representatives are responsible for the tax liabilities of the taxpayers they represent. Taxpayers file monthly VAT reports by the 25th of the month following the month in which the tax obligation arose, or quarterly, by the 25th of the month following the quarter in which the tax obligation arose. As a rule, VAT is paid to the tax office at the time of filing an appropriate VAT report. However, in the case of taxpayers paying VAT on a quarterly basis, monthly VAT withholdings must be made if the tax due results from the return filed for the previous quarter. Taxpayers with annual sales of less than EUR 1,200,000 are not required to make monthly withholdings (VAT can be paid quarterly). VAT is deducted, partially deducted or reduced if the criteria are met. As for example the VAT on accommodation and gastronomic services is not subject for deduction. The tax refund is usually paid into the bank account indicated by the taxpayer. As a rule VAT is refunded if requested by the taxpayer in a tax report, within 60 days from the date of filing an appropriate VAT report. The VAT refund period may be shortened to 25 days if additional criteria are met. In a typical hire purchase transaction, a car is purchased by an individual who will pay the capital cost of the car (VATable) and finance charges (exempt) over an extended period. There will often be two businesses involved: a car dealer, who makes a profit on the VATable sale of the car, and a finance company, which makes a profit on the exempt finance charges. However, the legalities of the transaction often involve the finance company both buying and selling the car. It will not make a profit on that part of the transaction, but it takes title to the car in order to have a claim on the asset in case of default. So the finance company might have a VATable input (the purchase of the car from the dealer) of €10,000 with €2,000 input VAT, a VATable output of €10,000 with €2,000 output VAT, and exempt income spread over the life of the agreement amounting to say €4,000. Oruga Group Business and Investment Law ► https://orugagroup.com/en Hi everyone, Today’s video topic Tax on civil law transactions (also called PCC) which is applicable to #realestate deals: In the case of an asset deal ( the direct purchase of an interest in real estate by a company or individual), where the seller is not an entity carrying on a #business , a 2% tax on civil law transactions (PCC) is applicable, based on the market value. This is normally the purchase price but can sometimes be assessed at a higher level by the tax authorities using an authorized expert's opinion, which happens very rare in practice. The obligation to pay PCC rests with the buyer and is pai at the notary. If the seller is an entity carrying on a business, value added tax (VAT) is usually payable. Generally, the standard rate of 23% applies. With respect to subsidized housing – a rate of 8% applies. In principle, VAT charged by the seller can be recovered by the buyer as input VAT (if the purchaser is a VAT taxpayer carrying out transactions which are subject to VAT). If a sale is subject to VAT, PCC is not applied. But the sale of agricultural land is exempt from VAT and but in such cases 2% PCC is paid. If a sale is exempt from VAT, it is subject to tax on civil law transactions (PCC) at a rate of 2%. In the case of a share deal for example the purchase of shares in a company being an owner of the real estate, PCC at 1%, calculated on the basis of the market value of the shares, is payable by the acquiring party. Similarly, if an interest in a partnership is purchased and #partnership is an owner of a real estate, PCC at 1% is also applicable, and is calculated on the basis of the market value of the interest. Question: What taxes do I need to pay? 1) Income tax to your local governing body (if you live in Australia, you’d pay it to the Australian government, if you live in the USA you’d pay it within the USA etc). 2) Sales tax. In the USA, sales tax is collected by individual states, and NOT the federal government. You will usually pay a state tax + a local district tax + in some cases, a special tax. In addition, some states are origin based (you pay the sales tax rate based on where the item is being shipped from) and some are destination based (you pay the rate based on where the customer is based). Destination based in tricker because the rate you collect/pay is always changing. Question: Who has to pay sales tax when dropshipping - me, the dropshipper, or both? First, determine whether you or your dropshipper has nexus in a state. Nexus is a legal term which means that your business has a sufficient physical presence in a state that means you need to collect and pay sales tax within it. Based on this, you’ll fit into one of 5 scenarios: 1) Your customer is based in Oregon, Delaware, New Hampshire or Montana Congratulations! These states don’t have sales tax so neither you nor your dropshipper have any obligations to collect/pay sales tax for these customers. 2) Neither you nor your dropshipper have nexus in your customer’s state Neither you nor your dropshipper need to collect/pay sales tax on these orders. 3) Your dropshipper has nexus in your customer’s state, but you don’t. Some states will require that they collect sales tax. But, if you provide them with a resale certificate/license, this sales tax can usually be waived. 4) You have nexus in your customer’s state, but your dropshipper does not. You need to collect/pay sales tax on the orders, not your dropshipper. 5) Both you and your dropshipper have nexus in your customer’s state You’ll need to provide your dropshipper with a resale certificate/license. It means they can waive the sales tax on the order between the two of you, and then you’ll be required to collect it from the customer. Question: How do I get sales tax waived? If you’re eligible to have sales tax waived you’ll need to get a resale certificate/license to prove that you’re buying the items for the purposes of resale. I recommend that you use a service called TaxJar. For Amazon.com it connects to your account to easily create reports that makes submitting your returns easy. In addition, if you’re selling on Amazon I recommend setting up their Amazon Tax Service. Here is how you do it: Step 1: Login to your seller account. Step 2: Click on settings and click “Tax Settings.” Step 3: Click “View/Edit your Tax Collection and Shipping & Handling.” Step 4: Choose how to manage your Product Tax Codes. To make it easy, you can select “Use Default Product Tax Code.” Step 5: Specify your Tax Collection Obligations. TaxJar have a free cheat sheet you can download which tells you which boxes to tick. TaxJar also connects to your Shopify account to make reporting easy. And be sure to set up your sales tax settings under the “Tax” option. Under physical presence, type in the state you have nexus in. If you have a physical address tied to your nexus, type in the ZIP for it too, and save that entry. Do this for each state. Shopify will now automatically add sales tax to each purchase in the states you have nexus in. Question: How do I pay the sales tax? You will need to file a report with each state and outline how much money goes to each district, city etc. Because of all of the different district/special taxes this is a lot of paperwork. That is why I recommend you use TaxJar’s autofile feature, which will file and pay your sales tax returns for you in 37 states. Legal differences between EU countries are one of the remaining barriers to the internal market. To boost cross-border trade, cut costs and give customers greater choice, the EU has drafted a Common European Sales Law. Maria Baeva Petrunova, from Bulgaria, experienced these obstacles first hand: "Last year I tried to buy a kindle online for my husband as a birthday present," she says, "but unfortunately I wasn't able to. I did everything I was required to to complete my order, but despite that, in the end they said they wouldn't deliver to Bulgaria". Both in her private life and as a dentist, Maria has found that she has greater choice and better prices if she buys her goods from abroad. But she quickly realised that things were not going to be that easy for her as a Bulgarian citizen. "I wanted to purchase supplies for my dental surgery from a German company via the internet." says Maria. "But the next day they sent me an e-mail saying that they couldn't process my order as it had to be 300 euros minimum for delivery to Bulgaria." Maria didn't want to place such a big order unless she could be sure about delivery times, packaging, and sales documents, which might not be compatible with the Bulgarian tax system. In the end, she did find a way to buy what she needed, but it wasn't easy: "I order goods from Germany to be sent to a friend's address there," she says. "My friend then sends the parcels to me or I collect them when I visit her. So that's the round-about way I found to get hold of my goods." Bulgaria is one of the countries in Europe where it is most complicated to purchase cross-border goods online. People living in Belgium, Latvia, Malta and Romania have similar problems. For them, 70 percent of cross-border transactions end in failure. The European average is hardly better: only four in ten cross-border deals work out. Ignat Arsenov is director of the European Consumer Centre in Bulgaria: "In many cases we're not given any explanation. Sometimes, the sellers simply state in their terms and conditions that they don't deliver to Bulgaria. Sometimes they say there is problem with the credit card. In many cases, traders mention the legal framework as part of the problem," he says. A seller can turn down an online transaction with someone in another country if he doesn't feel comfortable with the laws and regulations that would apply to the deal. E-commerce policy expert Stefan Krawczyk explains: "It's often a big challenge to be aware of all the details of the rights that are applied to a consumer's transaction in other countries. In particular for small companies, it's just too much for them to bare, and therefore they choose the simple solution wich is simply not to sell across borders," he says. Only 9% of consumers in Europe buy online from other countries. The same small number of sellers take on the challenge of cross-border trading. In response, the EU has decided to draft a Common European Sales Law. Family-run business Bivolino is among the first in Belgium to expand online to new markets. Today the company sells its products in 19 EU countries, but at what price? Carine Moitier is the co-founder of Bivolino.com: "First of all, you have to invest in your brand abroad. That's the first step," she says. "Then there's the language barrier, so you need native speakers to help you in each country. That also represents a considerable cost for a small company," she adds. "There's also the whole question of online payment, which varies from country to country. Other major obstacles include differences in VAT and consumers' rights. So, for example, in some countries, the maximum delay for returning goods is two weeks, in others it's only one week, so there again, we need to have a different approach according to the country." Each business transaction is based on a contract. Here again, rules vary between countries, making it more costly to export abroad. It's estimated that each additional export market costs a business an average of 10,000 euros. "In order to sell goods in another EU country, you first need to analyse that country's legislation," says Carine Moitier. "This means you need to hire a legal expert there, who will help you understand how the law differs from you country." I recently saw two clients who run a partnership, which is VAT registered, who were also considering purchasing an investment property together. I explained to them that if they did this, the rental income would be deemed as part of their VAT-able income and added on to that of the partnership. This meant that they would lose approximately 17 percent of their rental income to the VAT man. This would therefore have a major impact on their investment yield. We found a way around this to avoid the rental income being attached to the VAT income. VAT Refund is a tax incentive provided to an overseas passport holder in the form of a refund of the VAT already paid on the purchase of Taxable Goods in Indonesia, which is then taken out of the customs area or abroad. In principle Value Added Tax (VAT) is a tax on domestic consumption, so for goods consumed abroad should not be subject to VAT. Since VAT has been collected by the seller, then when the foreign national will leave the customs area granted VAT refund. A good news for tourists who are visiting the UAE. They will be provided with a refund system for the value-added tax. What does it mean? It means that Non-residents can refund VAT on purchases made from retailers registered in the system, which will go live soon, provided that such goods are not exempt from the tax system. Spaces will be provided where tourists can easily reclaim taxes through a fully electronic system, without any human involvement. Tourists shall submit the required documents and obtain a refund via credit card or in cash. This system will be implemented from the fourth quarter of 2018.
